What is a license and why is it needed?

Permission to useis the consent of the local government that the building meets the established requirements and can be used.

At first glance, it may seem like an unnecessary formality - if the owner lives in the house and everything is fine, why do you need an occupancy permit? However, this turns out to be a problem if you want to buy a house with bank financing. Today, banks are of the opinion that they will not finance the purchase of real estate without a use permit. If they should do so, then only if the lack of a permit is well justified or a clause is included in the loan agreement that the use permit is requested for a specific period of time. However, the lack of permission is unfortunately mostly behind the administration, which cannot be considered a valid reason for its absence. Thus, in many cases, you may find yourself in a situation where your own funds are lacking, the bank will not give a loan, and the home of your dreams remains unacquired.

 

However, even if you have built the house yourself or bought it with your own funds and plan to live there for the rest of your life, unexpected situations may arise where you have to sell the house. The insurance does not cover buildings without an occupancy permit

If the property does not have an occupancy permit, one of the biggest risks is insurance claims. How to check whether the building is legalized / whether there is a use permit?

The existence of a use permit can be checked in the environment of the building register (ehr.ee). To do this, proceed as follows:

1. Enter the building's address, cadastral code, etc. in the search.

2. Click on the "construction register code" of the building you are looking for

3. Select the sub-item “Documents” from the list

4. If the use permit has been issued and entered in the register, you can find the use permit in the list of documents.

What documentation is required to apply for a use permit?

When applying for a use permit, the following must be submitted:

 

  1. The construction project according to which the building is built

  2. Construction expertise audit report*

  3. Electrical installation audit

  4. Deed of demarcation of the building or post-construction control measurement

  5. Heating system expertise* togetherwith a chimney sweep act

  6. Fire safety audit

  7. Copies of water and sewerage, electricity supply and garbage collection contracts (gas contract in the case of gas heating)

  8. Payment order proving the payment of the state fee
